DMCA Policy
1. Filing a Copyright Notice
If you believe content on Emberlitt infringes your copyright, send a notice to legal@emberlitt.com with the subject line "DMCA Notice." • Include your full name and contact information. • Identify the copyrighted work you claim has been infringed. • Identify the allegedly infringing material and enough information for Emberlitt to locate it, such as URLs, usernames, post IDs, message IDs, or book or media identifiers. • State that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law. • State that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner. • Include your physical or electronic signature.
2. What Emberlitt May Do
After receiving a valid notice, Emberlitt will act expeditiously, typically within 5 business days, to remove or disable access to the material, notify the affected reader, preserve evidence, and take additional action under the Terms of Service, including against repeat infringers.
3. Counter-Notification
If you believe material was removed or disabled by mistake or misidentification, you may send a counter-notification to legal@emberlitt.com with the subject line "DMCA Counter-Notice." • Include your name, address, email address, and phone number. • Identify the material that was removed or disabled and where it appeared before removal. • State under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification. • State that you consent to the jurisdiction described by applicable DMCA law and will accept service of process from the original complainant or that person’s agent. • Include your physical or electronic signature.
4. Forwarding and Restoration
Emberlitt may forward your counter-notification to the complaining party. Emberlitt may restore the material if the complaining party does not file a court action within the time required by applicable law (typically 10–14 business days after receiving the counter-notification).
5. Repeat Infringers
Emberlitt may suspend or terminate accounts of repeat infringers and may restrict uploads or sharing privileges where infringement risk is repeated or serious.
6. Misrepresentations
Submitting false or misleading copyright notices or counter-notifications may result in legal liability under 17 U.S.C. § 512(f) and account enforcement under the Terms of Service.
7. Public Domain Content
Many books and audiobooks available on Emberlitt are sourced from public domain archives, including Project Gutenberg and LibriVox. These works are believed to be in the public domain in the United States. Emberlitt does not claim copyright over public domain works and provides them for readers’ personal use. If you believe a work identified as public domain is actually subject to copyright protection, please contact legal@emberlitt.com with details so that Emberlitt can investigate and take appropriate action.
8. Safe Harbor
Emberlitt operates as an online service provider under the Digital Millennium Copyright Act (17 U.S.C. § 512). Emberlitt does not monitor all content uploaded by readers and is not liable for infringing material posted by readers, provided that Emberlitt complies with the notice-and-takedown procedures described in this DMCA Policy. Emberlitt will act expeditiously to remove or disable access to infringing material upon receiving a valid takedown notice.
